When disputes involving discipline or rules cannot be resolved on-property between System Council No. 9, IBEW and Bombardier Labor Relations, the System Council has the option to pursue the matter through arbitration. The process is overseen by the National Mediation Board, an entity of the federal government which also funds arbitration.


Our cases with Bombardier are handled by the National Railroad Adjustment Board's Second Division. We currently have one discipline case pending, but not yet scheduled by the Board.


On December 10, 2019, General Chairman/Secretary-Treasurer Giuliano submitted the IBEW's Section Six Notice to Bombardier Transportation, in which the IBEW advised Bombardier what is being sought in the new contract.

On February 3, 2020, Bombardier filed their Section Six Notice with the IBEW. 

Negotiations were held on February 18 and 19, 2020, after which negotiations quickly came to a halt, with COVID making it difficult to resume talks.

On September 24, 2020, Bombardier and the rail labor coalition participated in a videoconference to discuss how and why negotiations broke down. Bombardier will be providing a list of potential dates to get the parties back to the table.
